AEROSOL CAN REGULATION UPDATE

Aerosol cans are widely used for dispensing a broad range of products including paints, solvents, pesticides, food, and personal care products. According to research conducted by the Household & Commercial Products Association (HPCA), Aerosol cans can account for nearly 40 percent of retail items that are managed as hazardous waste at large retail facilities.

On December 9, 2019, the US EPA decided to add aerosol cans to the list of universal waste regulated under title 40 of the Code of Federal Regulations (CFR), part 273. This was done to reduce the regulatory burden associated with handling and managing aerosol cans, especially those determined to meet hazardous waste definitions.

Effective July 8, 2023, New York State Department of Environmental Conservation (NYSDEC) will become the latest RCRA-authorized state agency to add aerosol cans to the list of waste streams that can be managed as universal waste in the state of New York. Massachusetts is another state that is in the process of adopting the universal waste rules for managing aerosol cans. The rule is currently in the post public comment phase and is expected to become effective in Summer 2023.

Regulatory compliance is at the forefront of everything we do here at g2, and you can rely on us to keep your company up to date as these regulations change.
